    Ask the Attorney

    Hi Everyone,

    I wanted to intorduce myself to the forum and offer my services to anyone that needs them.  I am the owner of Confidence Title & Escrow, located in Gaithersburg, Md.  I became a member of e-agent a few months ago and am thrilled to be a part of this site.  As a matter of fact, I just launched my website at www.confidencetitle.com and have begun a blog page for anyone with questions regarding real estate issues.  I have been in the real estate field since 1990 and have been through a few peaks and valleys.

    How did you grow your buisness through this service, because I am a loan officer and I wanna be the biggest loan officer with alot of client. So if you can help me out that would be appericate. thank you and looking forward to hear back from you.

    Thanks for your question.  This service, as well as many other marketing endeavours, is part of our marketing plan.  One site will not make you the biggest nor the best.  The best way to get business and to grow is to do a good job, look out for the best interest of the customer and follow-up with the parties after the transaction.  We have grown mainly through this model and word of mouth has kept us busy.

    Good morning Victor, my name is Cynthia Wiggins and I have ran into a problem with my condo association and I'm hoping that you could answer a question for me so I know how to broach this problem.  I purchased a condo with this association in august of 2007 and found out recently over the past few months that there's a problem with my HVAC system.  I am currently running my system at 80 degrees to keep warm enough wearing just a sweater.  I have contacted the association several times about this problem.  They have been out to my condo to address/fix the problem twice but of course the same thing is still going on.  I want to know if I have a legal right to take my association to court since they are totally ignoring this problem.  Our agreement in the contract is they are responsbile for the fixtures if needed in the condo for one year.  I have a utilities bill that is running at over $300 monthly and I cannot afford these type of payments with having to pay condo fees, mortgage and so forth.  If you could please advise me of what I can do to get this problem resolved I would greatly appreciate it.  Thank you and I look forward to your response.

    Hi Ms. Wiggins,

    My best advice to you, and not suggesting anything other than my opinion, is to get the heating system checked by an independent company and then present that information to the association as evidence that the system is not functioning properly (if that is the case).  If they still refuse to address the repair, I would go ahead and get the repaid done and then file a small claims suit against the association (if you truly believe that they are responsible for the system).

    Thank you Victor for your response.  I have a person coming out to my place today to check the system so that I can show proof of it not being in proper working condition.  If the conclusion reflects on it not being in working order am I able to seek legal help in taking them to court and seeking damages.  I feel that if this is proof (and only because everyone in the building has experienced the same problem) does this prove breach of contract with the association?  They had to have known this was a problem before hand because they had taken an apartment complex and turned it into condos.  If it does state that it is a breach of contract am I able to get out of this contract?
